Welcome to up0. By accessing or using our uptime monitoring services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using up0's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these terms.

2. Service Description

up0 provides uptime monitoring, latency tracking, and SLO management services across multiple global regions. Our services include:

  • Multi-region health checks and monitoring
  • Real-time alerting and notifications
  • Performance analytics and reporting
  • API access and integrations
  • SLO tracking and error budget management

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your account information is accurate and up-to-date
  • Notifying us immediately of any unauthorized access
  • Compliance with all applicable laws and regulations

4. Acceptable Use

You agree not to:

  • Use our services for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Use automated means to access the service excessively
  • Resell or redistribute our services without permission
  • Monitor or collect data from third-party websites without authorization

5. Subscription and Billing

Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all applicable fees.

We reserve the right to modify our pricing with 30 days notice. Continued use after price changes constitutes acceptance of new pricing.

You may cancel your subscription at any time. Refunds are provided on a pro-rata basis for annual subscriptions only.

6. Service Level Agreement

We strive to maintain 99.9% uptime for our monitoring infrastructure. Service credits may be available for extended outages as outlined in our SLA documentation.

Scheduled maintenance will be announced in advance when possible. Emergency maintenance may be performed without notice.

7. Limitation of Liability

To the maximum extent permitted by law, up0 shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service.

Our total liability for any claims related to the service shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Data and Privacy

Your use of our services is also governed by our Privacy Policy. We collect and process data as described in that policy.

You retain ownership of your data. We will not access or disclose your data except as necessary to provide the service or as required by law.

9. Termination

We may suspend or terminate your account if you violate these terms or engage in conduct that we determine to be harmful to our services or other users.

Upon termination, your right to use the service will immediately cease. We will retain data as required by law or for legitimate business purposes.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the service.

Continued use of the service after changes become effective constitutes acceptance of the modified terms.
